Francisco Fernandez del Castillo

Employment Lawyer | Civil Rights Attorney | Whistleblower Attorney | Non-Compete Defense | Complex Commercial Litigation

Francisco Fernandez del Castillo is a litigation-tested employment and civil rights lawyer with a national practice focused on workplace rights, whistleblower protection, and complex business disputes. He brings proven experience and a mission-driven commitment to achieving justice for his clients—often workers and individuals facing powerful employers, corporations, or institutions.

Francisco represents employees in cases involving sexual harassment, racial discrimination, wage theft, failure to pay overtime, employee misclassification, workplace privacy violations, and retaliation. He also advises and defends individuals in disputes over non-compete agreements and non-solicitation clauses, protecting careers and mobility against restrictive employer practices.

As a whistleblower attorney, Francisco represents individuals who expose corporate fraud, including claims under the False Claims Act and related whistleblower protections. He helps clients navigate retaliation risks while pursuing remedies that hold institutions accountable.

Francisco has also handled a significant number of large-scale employment and privacy cases, securing relief for hundreds of workers. His work includes class settlements under the Illinois Biometric Information Privacy Act (BIPA) and wage-and-hour collective actions under the Fair Labor Standards Act (FLSA).

In addition to his plaintiff-side employment and whistleblower practice, Francisco is a trusted commercial litigation attorney. He has represented clients across the country, including in the Delaware Court of Chancery, in matters involving breach of contract, fiduciary duty, shareholder disputes, and unfair business practices. His ability to manage discovery-intensive and multi-party cases makes him a strong advocate in high-stakes disputes from pre-suit strategy through trial.

Francisco began his career at Boies Schiller Flexner LLP, where he worked on nationally prominent litigation and appeals. He later served as a Civil Rights Attorney at the Mexican American Legal Defense and Educational Fund (MALDEF), advocating for immigrant and minority communities.

Fully bilingual in English and Spanish, Francisco provides culturally competent representation to a diverse client base. He earned his J.D. from the University of Virginia School of Law, where he was a Dean’s Scholar, and his B.A. in Arabic and Philosophy from the University of Notre Dame.
